On December 13th, 2024, an amendment to the Civil Code of the Russian Federation was published. It comes into force from January 13th, 2025.

The amendment relates to Part 3 of Article 574 of the Civil Code of the Russian Federation.

In the current version, the real estate donation agreement is subject to state registration. Instead, the new version reads: “The contract of donation of real estate concluded between citizens is subject to notarization”.

This amendment will come into force on January 13th, 2025.

Now, as a general rule, there is no need to notarize a real estate donation agreement between two individuals. The exceptions are transactions involving the alienation of real estate of a minor or a person with limited legal capacity.

As a general rule, it is the notary who certified the contract who submits an application for registration of rights to the Federal Register. However, the parties to the agreement are allowed to apply for this public service to the Federal Register themselves.
